Terms of Use

Medical Live (hereinafter referred to as the “Company”) values ​​your personal information and complies with the Act on Promotion of Information and Communications Network Utilization and Information Protection.

The Company informs you of the purposes and methods for which your personal information is used and what measures are taken to protect your personal information through the Personal Information Handling Policy.

If the Company revises the Personal Information Handling Policy, it will notify you through a website notice (or individual notice).

Chapter 1 General
Article 1 (Purpose)
The purpose of these Terms of Use is to stipulate the terms and procedures for using the information service (hereinafter referred to as the “Service”) provided by Medical Live (hereinafter referred to as the “Company”), as well as other necessary matters.

Article 2 (Validity of Terms and Conditions)
These terms and conditions shall take effect by notifying them through the Medical Live (https://medicallive.co.kr) screen service or notifying members by e-mail or other methods. The company may change the contents of these terms and conditions when necessary, and the changed terms and conditions shall take effect from the time of notification or notice in the same manner as in Paragraph 1.
Article 3 (Rules other than terms and conditions)
Matters not specified in these terms and conditions shall follow the provisions of relevant laws and regulations.

Article 4 (Definition of Terms)
The definitions of terms used in these terms and conditions are as follows.

“Member” refers to an individual or corporation that has entered into a contract with the company regarding the use of the service and has been issued a member ID. “Member ID” refers to a combination of letters and numbers selected by the member and approved by the company for the purpose of identifying the member and allowing the member to use the service. “Password” refers to a combination of letters and numbers selected by the member to protect his or her own confidentiality in communication. Chapter 2 Conclusion of Service Agreement
Article 5 (Establishment of Service Agreement)
The service agreement is established when the company approves the service applicant’s application for service use.

Article 6 (Application for Service Use)
In principle, the service applicant shall faithfully write and register the member information requested by the company. When the applicant reads these Terms of Use, fills in the relevant information in the membership application form, and clicks the “Agree” button, it is considered that the applicant legally agrees to these Terms of Use.
Article 7 (Reservation of Acceptance of Application for Service Use)
The company may restrict acceptance of the application for service use in the following cases and reserve acceptance until the reason is resolved.
In this case, the company shall notify the applicant of this by email, etc. However, cases where the company is unable to notify the applicant for service use due to reasons not attributable to the company are an exception.

Article 8 (Rejection of Application for Use)
The company will not accept the application for use if it is aware of any of the following items.

Article 9 (Cancellation of Contract)
When a member wishes to cancel the service use contract, the member must submit a cancellation request to the company in advance online (e-mail), in person, by phone, or by fax. If any of the following reasons occur to the member, the company may cancel the contract without prior notice.

① If the company’s reputation is damaged
② If the service operation is intentionally disrupted
③ If another member’s ID and password are stolen
④ If an act that undermines social customs and public interest is planned or executed
Chapter 3 Service Use
Article 10 (Change in the scope of service provision)
If necessary, the company may add or change the contents of the service. In this case, the company makes it a rule to announce the contents in advance.

Article 11 (Service Use)
In principle, the service is available 24/7, unless there are special business or technical difficulties for the company. However, the service may be suspended due to force majeure such as system maintenance, backup, etc., or system failure or service usage overload.
Article 12 (Provision of information and posting of advertisements)
When operating the service, the company may provide various information to members by posting it on the service. If necessary, the company may add or change the contents of the service. In this case, the company makes it a rule to announce the contents in advance. The company may post advertisements on the service screen, e-mail, etc., in relation to the operation of the service. Chapter 4 Rights and Obligations
Article 13 (Company Obligations)
Except in the cases provided for in Article 11, the Company shall make every effort to provide continuous and stable services in accordance with the provisions of these Terms and Conditions. The Company shall maintain and repair the equipment related to the Service in a state where it can always be operated, and shall make every effort to repair and restore it without delay in the event of a failure. If the Company receives a complaint from a member regarding the Service, it shall process it immediately, and if it is difficult to process it immediately, it shall notify the member of the reason and processing schedule through the Service or e-mail.
Article 14 (Protection of Privacy)
The Company shall not disclose, disclose, or distribute the member’s personal information obtained in relation to the Service to a third party without the member’s prior consent, and shall not use it for commercial purposes other than those related to the Service. However, this shall not apply in the following cases:

① When requested by a relevant agency for investigative purposes in accordance with relevant laws and regulations
② When requested by the Information and Communications Ethics Committee
③ In other cases in accordance with relevant laws and regulations, the company may prepare and use statistical data on the personal information of all or some members and send cookies to the member’s computer through the service if the member’s consent is obtained or if it is determined that there is no serious infringement on the member’s privacy. In this case, the member may change the settings of the computer browser used to refuse to receive cookies or to warn about the receipt of cookies.
Article 15 (Member’s Obligations)
Members must comply with relevant laws and regulations, the provisions of these Terms and Conditions, the user guide and precautions, and other matters notified by the company, and must not engage in any acts that interfere with the company’s business. Members may not engage in any commercial activities using the service without the company’s prior consent. Members may not copy, reproduce, change, translate, publish, broadcast, or use information obtained through the service in any other way without the company’s prior consent, or provide such information to others. Members must not engage in the following acts in relation to the use of the service:

① Acts of illegally using another member’s ID
② Acts for the purpose of criminal activity or other acts related to criminal activity
③ Acts that harm good customs or other social order
④ Acts that defame or insult others
⑤ Acts that infringe upon others’ intellectual property rights, etc.
⑥ Hacking or distributing computer viruses
⑦ Acts of continuously transmitting certain content such as advertising information against the will of others
⑧ Any acts that interfere with or are likely to interfere with the safe operation of the service
⑨ Other acts that violate relevant laws
Article 16 (Deletion of Posts or Contents)
The Company may delete posts or contents of the Service without prior notice or consent if they violate the provisions of Article 15 or exceed the specified posting period.

Article 17 (Rights and Obligations Regarding Posts)
All rights and responsibilities for posts, including copyrights, belong to the member who posted them.

Article 18 (Prohibition of Transfer)
Members may not transfer or donate their right to use the service or other contractual status to others, and may not provide it as collateral.

Article 19 (Compensation for Damages)
The Company shall not be liable for any damages suffered by members in connection with services provided free of charge, except in cases where such damages are caused by gross negligence of the Company.

Article 20 (Exemption from Liability and Compensation)
The Company shall not be liable for the accuracy, reliability, etc. of the information, data, facts, etc. posted by members on the Service. Members use the Service at their own risk. Members shall be fully responsible for any damages that may arise from the posting or transmission of data using the Service, or for any disadvantages that may arise from the selection of data or other use of the Service. Members shall be fully responsible for any damages that may arise from the management or use of member IDs and passwords, or from unauthorized use by third parties. If the Company is held liable to a third party due to a member’s violation of Article 15 or other provisions of these Terms and Conditions, and thereby incurs damages to the Company, the member who violated these Terms and Conditions shall compensate the Company for all damages incurred and indemnify the Company against such damages. Article 21 (Dispute Resolution)
The Company and its members shall make all necessary efforts to amicably resolve any disputes that arise in connection with the Service. Notwithstanding the above provisions, if a lawsuit is filed due to such dispute, the lawsuit shall be under the jurisdiction of the court having jurisdiction over the location of the Company’s head office.

Supplementary Provisions
Article 1 (Enforcement Date)
These Terms and Conditions shall be effective from July 20, 2022.
